Terms and Conditions for Pest Control Services


1. Definitions

"Company" shall refer to Eco-Guard Environmental Services.

"Client" shall refer to the individual or legal entity commissioning the services.

"Services" shall denote the activities related to pest inspection, treatment, prevention, and associated undertakings.

2. Service Agreement

The booking or acceptance of Services by the Client constitutes full agreement with and acceptance of these Terms and Conditions. The Company undertakes to execute the pest control services utilising reasonable care, professional skill, and in strict compliance with all applicable legislation and prevailing industry standards.

3. Scope of Services

Services shall encompass the inspection, identification, appropriate treatment, and provision of professional recommendations.

Treatment methodologies may incorporate chemical, mechanical, or biological solutions.

The Company retains the sole right to determine the most appropriate course of treatment based upon a professional assessment of the situation and risk factors.

The efficacy of pest control outcomes is contingent upon a multitude of variables, including but not limited to, environmental conditions, standards of hygiene, and structural integrity; consequently, the complete assurance of eradication cannot always be guaranteed.

4. Client Responsibilities

The Client is formally required to:

  • Furnish accurate and comprehensive disclosure pertaining to pest activity and the prevailing condition of the property.
  • Grant safe, unobstructed, and timely access to the property for the duration of the scheduled service.
  • Adhere strictly to all preparatory and aftercare instructions issued by the Company.
  • Ensure the exclusion of children, domestic animals, and all non-essential personnel from the designated treatment areas as professionally advised.
  • Maintain satisfactory standards of hygiene and housekeeping practices where such standards bear relevance to the pest control operation.

Failure to comply with these stipulations may materially compromise the effectiveness of the treatments and may constrain the Company's capacity to deliver the contracted Services.

5. Health and Safety (H&S) and Use of Pesticides

The Company conducts all operations in strict adherence to all pertinent UK health and safety legislation and pesticide control regulations.

All pesticides deployed are professionally approved and applied in accordance with the manufacturer's guidelines and statutory requirements.

A site-specific risk assessment may be conducted by the Company prior to the commencement of treatment.

The Client is obliged to notify the Company of any existing allergies, vulnerabilities, or the presence of domestic animals on the premises.

All safety instructions provided, including mandated re-entry periods, must be rigorously observed.

The Company accepts no liability for issues arising from the Client's failure to adhere to safety guidance or the non-disclosure of material information.

6. Pricing and Payment

The agreed price for the Services shall be confirmed prior to service delivery.

Full payment is mandated prior to the commencement of service delivery, unless an alternative arrangement has been formally agreed upon in writing by an authorised representative of the Company.

The Company reserves the right to suspend or withhold the provision of Services until receipt of the requisite payment.

A deposit may be required at the discretion of the Company.

Payments received after the stipulated due date may be subject to additional late payment charges.

7. Cancellations and Rescheduling

A minimum notice period of twenty-four (24) hours is required for any cancellation or rescheduling request.

Cancellations submitted with less than the required notice may result in the imposition of a cancellation fee.

The Company retains the right to reschedule appointments due to circumstances pertaining to operational necessity or safety considerations.

8. Disclaimer of Guarantees and Warranties

No formal guarantees or warranties are extended by the Company regarding the absolute eradication or permanent prevention of pests.

The final outcomes are inherently dependent upon external factors that are beyond the direct control of the Company.

9. Limitation of Liability

The Company shall not be held liable for any pre-existing damage, unidentified hidden infestations, or the occurrence of re-infestation following the service.

The Company’s aggregate liability shall be strictly limited to the monetary value of the Services rendered.

10. Access and Property Conditions

The Client must ensure the provision of safe and suitable access to all required areas.

The Company reserves the right to decline or suspend Services should unsafe working conditions be encountered.

11. Environmental Considerations

The Company endeavours to minimise its environmental footprint and will employ integrated pest management (IPM) principles in its service delivery.

12. Complaints Procedure

All complaints must be formally reported to the Company within seven (7) days of the service date.

The Company commits to conducting a thorough investigation and providing a formal response within a reasonable timeframe.

13. Termination

Either party reserves the right to terminate this agreement upon providing formal written notice.

Payment for all work completed up to the date of termination shall remain due and payable.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

15. Amendments

These Terms and Conditions are subject to revision and update by the Company at any time.

17. Data Protection and Privacy (UK GDPR)

The Company operates in full compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Personal data is collected solely for the purposes of service delivery, communication, and invoicing.

Data processing is conducted under the lawful bases of contractual necessity and legitimate interests.

All data is stored in a secure manner and shall not be disclosed to third parties unless mandated by legal obligation.

Clients are entitled to exercise their statutory rights regarding the access, correction, or erasure of their personal data.

18. Confidentiality

All information pertaining to the Client shall be maintained in the strictest confidence, save for instances where disclosure is legally required.

19. Insurance

The Company maintains all necessary and appropriate insurance coverage relevant to its operations.

20. Force Majeure

The Company shall not be held liable for any delays or failures in performance resulting from events or circumstances beyond its reasonable control.

21. Severability

Should any provision of these Terms be deemed invalid or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions.

22. Commercial / Contract Clients (Business, Landlords, Letting Agents)

Where Services are provided pursuant to a commercial arrangement, supplementary written contracts, Service Level Agreements (SLAs), or formal pest management plans may be applicable and supersede specific clauses herein.

The Client is obligated to adhere to all recommendations concerning hygiene, structural proofing, waste management, and structural maintenance.

Regular servicing contracts (e.g., monthly or quarterly visits) are intended for risk management and reduction, and do not constitute a guarantee of continuously pest-free premises.

The Company shall not be held responsible for pest activity resulting from the actions of third parties, tenant behaviour, conditions on neighbouring properties, or the Client’s failure to implement professional recommendations.

Missed scheduled visits attributable to the Client's failure to provide access may still be subject to full charge.

Formal written reports, site plans, and compliance documentation may be furnished for audit or regulatory inspection purposes.
